NJ/DC: Menendez backers stand by their man

…[Stop FEMA Now Leader George] Kasimos said Menendez won a committed following by challenging the way the Christie administration was managing federal grants for Sandy recovery, sponsoring a law last year that repealed many increases in flood insurance rates that Congress ordered in a 2012 law, and pressuring FEMA to reopen flood insurance claims after reports that insurance companies were low-balling payments.

“I’m a Jersey guy,” Kasimos said. “You got my back, I got your back.”

Jay Whalen of Jackson, who is nearly finished rebuilding his vacation house in Little Egg Harbor, said Menendez’s staff intervened when he could not get a flood insurance payment he deserved because an adjuster was insisting on a certificate of occupancy that the law did not require.

“I am a registered Republican, although I vote for the person, not the politics,” Whalen wrote on Facebook. “Senator Menendez has done more for NJ people, especially Sandy victims, than Christie has. His staff are working hard and he is for the people.” …

Menendez says he’s received no subpoenas, basks in support of N.J. colleagues

…Despite Menendez’s reticence, the press conference was a show of political support for the senator by his Democratic colleagues, who took pictures with him and praised him, none more than his Senate colleague, Cory Booker (D-N.J.)

Booker urged his colleagues to applaud loudly for Menendez, and said that the senator was his “go-to guy” when Booker was mayor of Newark.

“I am the Robin to his Batman. The Starsky to his Hutch. On bad days, the Laverne to his Shirley,” Booker said.

U.S. Rep. Bill Pascrell (D-9th Dist.) made no mention of superheroes or 70s sitcoms in his praise of Menendez.

“All of us should be thanking Robert Menendez, our senator,” he said.

And Jersey City Mayor Steve Fulop praised Menendez for helping get the light rail started in Jersey City as a member of the U.S. House.

“If you go back to the mid-90s, we are grateful to the advocacy of Senator Menendez for making that a reality,” Fulop said…

Bob Menendez Continues With Business As Usual Amid Potential Career-Ending Investigations

….In a brief interview last week, Menendez dismissed the notion that the investigations and the external distractions have affected his work.

“I haven’t missed a beat,” he said defiantly, ticking off the hearings he’s overseen, meetings on immigration and work on bipartisan legislation. “Nothing has impeded my ability to have an impact on what I care about.”

Rubio said he has a good working relationship with Menendez that dates to their time together as members of the Foreign Relations subcommittee on Western Hemisphere and global narcotics affairs.

“He’s the same intense and focused Bob Menendez I’ve known in the two years I’ve been here,” Rubio said. “The Bob Menendez I see today works just as hard, if not harder, than the one I saw the last year. There’s very few people in this building that work as hard or as intensely as he does.”

Sen. Chuck Schumer, D-N.Y., has worked closely with Menendez on immigration as well as ensuring an aid package for victims of Superstorm Sandy, assistance vital to New York and New Jersey residents. With New Jersey’s other senator, Frank Lautenberg, ailing, Menendez took on an outsized role in working on the aid.

Schumer said Menendez has been critical on immigration, adding that the investigations have not affected his work.

Statement of Abbe D. Lowell – 4-1

As we have seen in so many cases – from former HUD secretary Mike Espy’s in 1999 to former senator Ted Stevens in 2007 to former senator John Edwards two years ago – prosecutors in the Justice Department often get it wrong. These charges are the latest mistakes.

This investigation started with false and salacious allegations made by political and other opponents of Senator Menendez; it was fueled by heavy-handed actions of agents pressuring witnesses; and then it had more than its fair share of improper leaks to the press. I have asked the Justice Department to investigate this misconduct and I can only hope they do so with as much vigor and as many resources they have used against Senator Menendez.

What does it mean to be indicted?

An indictment is the paper that prosecutors write and present in a grand jury where the Senator had no chance to respond or participate. In fact, at all trials, judges tell juries that indictments are nothing more than a way case begins and is not evidence of anything. Judges also will tell juries that in this country you are innocent until proven guilty and soon Senator Menendez will have has his first chance to respond to the charges.

Doesn’t the Senator have to step down if he is indicted?

An indictment is nothing more than a formal charge, done in a one-sided manner by prosecutors. The Senator – like any American – is deemed innocent all the way to a trial verdict. It would defeat that presumption of evidence if people quit their jobs on mere charges. Consequently, the Senator is not obligated to resign and has no intention to do so.

The Senator has a job to do and that is to serve the people of the great State of New Jersey and the nation. He will continue to do that job and looks forward to being exonerated in court.

How did this all start?

Just days before he was re-elected, political opponents of the Senator – using right wing media – began a smear campaign against him, paying people to make wild, false allegations about him. These political opponents even concocted an anonymous tipster who went by the fictitious name Pete Williams, coincidentally the same name as the last U.S. Senator from N.J to be convicted of corruption. This tipster spent several months leading up to election day peddling unsubstantiated smears to the FBI and major media outlets.

Some of the people involved in making those false allegations eventually admitted they were paid to make up lies about Bob Menendez and recanted their stories. Unfortunately, “Pete Williams” and the people who financed and directed this smear campaign have never been identified, located, or brought to justice.

Filing a false report to the FBI is a crime. In this case, that crime led the Justice Department to begin a costly investigation into the Senator, but there is no sign they have ever investigated who committed fraud against the government in the beginning.

Why do you believe DOJ is wrong and will be proven so?

The Justice Department makes lots of mistakes in bringing these cases – the prosecutions of former HUD Secretary Mike Espy and former Senators Ted Stevens and John Edwards are just some examples. This is another mistake. Bob Menendez and Salomon Melgen are close friends and have been so for more than two decades. Under the law, friends are allowed to give gifts to public officials, and that is exactly what has happened in this case. The two have exchanged gifts and have attended each other’s family events for years.

Why do you believe DOJ allowed these charges to move forward?

All we know is that case began with a lie, and has been fueled with illegal leaks to the media since its start. It is unfortunate that instead of pursuing the people who committed a crime in order to smear a United States Senator, the Department has brought these unfounded charges. We look forward to proving them wrong in court.

Describe the process. What’s next?

The next step is for the government to attempt to prove its case in court. It has the very high burden of doing so. It could be some number of months before that begins, and there could be procedural disputes before any trial. But eventually there will be a trial, and we look forward to showing that the Senator’s actions were appropriate at all times.

How long will the case last?

It’s hard to say definitively, and it’s not something that is within our control. The Justice Department will eventually present its case in court and we will present ours.

LETTER: Menendez biggest advocate for victims of Sandy

Regarding the March 20 letter “Politicians late to game on Sandy Fraud,” I lost my home to Sandy, was cheated on flood insurance and have been very active on this issue. I assure you that some of our leaders were there for us from the beginning.

State Senate President Stephen Sweeney developed the Sandy Bill of Rights, which was vetoed by Gov. Chris Christie. U.S. Sen. Cory Booker, D-N.J., has been fighting for justice for Sandy victims all along. However, one man, U.S. Senator Robert Menendez, D-N.J., stands above all others.

Menendez is the biggest advocate Sandy victims have had since the day of the storm. While our own governor hangs us out to dry, ignoring Sandy issues while he runs around the country trying to get himself elected president, Menendez and his staff are here in the trenches with us every day.

He has no hesitation taking on corporations and FEMA on our behalf, and he has made himself some powerful enemies doing so. This has not made him shrink from defending us one bit. He has been the one bright light in the darkness that FEMA and the insurance companies have plunged us into.
